1. The defendant shall pay 128,378,250 won to the plaintiff and 20% per annum from August 1, 2014 to the day of complete payment.

1. Facts of recognition;

A. On March 15, 2013, the Plaintiff entered into a contract with B for the construction of a site for 333,06 square meters of Gyeonggi-gun, Gyeonggi-do (hereinafter “instant construction”) as the construction cost of KRW 164,00,000 (excluding value-added tax). The Defendant guaranteed the Plaintiff’s obligation to pay the said construction cost on the same day, and simultaneously held the Defendant liable as a contractor.

B. The Plaintiff, while carrying out the construction in accordance with the above contract, completed the construction in the part of the “soil” and “stowing hole” among the instant construction works, and accordingly, the amount of the construction in question is equivalent to KRW 128,378,250 [including KRW 75,950,00 for the portion of the price of earth and sand, which is set at KRW 75,57,500 for the portion of the price of stone, which is set at KRW 75,200 for the price of stone, which is set at KRW 5,57,500 for the portion of the price of stone, which is set at KRW 11,150,00 for each of the above construction in question x 5%) x value-added tax].

According to the above facts of recognition, the Defendant is obligated to pay to the Plaintiff damages for delay calculated at the rate of 20% per annum from August 1, 2014 to the day of complete payment, which is the next day after being served with a copy of the complaint, which is the total amount of KRW 128,378,250, and the copy of the complaint.

3. Thus, the plaintiff's claim is justified.
