Defendants shall be punished by imprisonment for eight months.

However, with respect to the defendant A, it shall be for two years from the date this judgment becomes final and conclusive.

『2013고단3261』 피고인 A는 2013. 8. 7. 15:40경 서울 양천구 신정동 소재 서울남부지방법원 청사 1층 종합민원실에서 자신의 소장을 접수하는 담당자들에게 성명과 자필서명을 요구했으나 이에 불응하여 증거를 확보하겠다는 것을 핑계로 법원 직원들의 얼굴 및 민원실 내부를 허락 없이 휴대폰으로 촬영하며 소란을 피우던 중 신고를 받고 출동한 청사보안팀 소속 피해자 C, D, E, F이 법원 청사 정비에 관한 규정에 의거하여 위 피고인의 행위를 제지하며 촬영 중단을 요구하자 이에 화가 나, 약 20명의 민원인들과 직원들이 지켜보는 가운데 20여분 가량 피해자들에게 “이 양아치 같은 놈의 새끼들, 법원장이 시켰냐 이 개새끼들아, 이런 씨부랄놈들, 법원장 오라고 해 양아치들아”라는 등으로 큰소리로 욕설하여 공연히 피해자들을 모욕하였다.

그러자 피고인은 위 법원 남문 앞에서 법원 직원들과 민원인들이 지켜보는 가운데 위 F에게 “G가 양아치니까 똘마니들이 양아친가, 자네 양아친가!”라고 욕설하고, 위 C에게 “양아치들아!”라고 말하는 등 큰소리로 욕설하여 공연히 피해자들을 모욕하였다.
