1. Basic facts

A. The Plaintiff is a company aimed at energy technology service business, etc., and the Defendant’s Intervenor Youngjin-gu Co., Ltd. (hereinafter “ Intervenor Youngjin-gu Co., Ltd.”) is a company engaged in earth construction business, etc., and the Intervenor Lee Sung-sung Co., Ltd. (hereinafter “ Intervenor Lee Sung-sung”) is a company aimed at manufacturing and selling measuring instruments and automated process control systems. The Defendant is a market-type public corporation under the Act on the Management of Public Institutions for the purpose of developing power resources.

B. On November 3, 2014, the Defendant: (a) with respect to the maintenance services for measurement and control facilities at the Han-gu Two Power Plants, a nuclear power plant that the Plaintiff was performing under a contract (hereinafter “instant maintenance services”), the Defendant is the first tender of this case (hereinafter “the instant first tender”) at U14-S193-000 public tender notice number;

(a)The participants shall be the tender guide, a business explanatory note, a request for participation in the service, the tender documentation, the general terms and conditions of the contract, special terms and conditions of the contract, and the evaluation criteria for the prior project performance capabilities;
