A defendant shall be punished by imprisonment for not less than two months.

Punishment of the crime

1. Around January 12, 2015, the Defendant stated that “Around January 2015, the Defendant would first lend KRW 50 million to the victim BM at the French coffee shop near Busan Shipping Daegu.”

However, even if the defendant received money from the victim as a loan interest, he did not have the intention or ability to lend 50 million won to the victim.

On February 12, 2015, the Defendant, by deceiving the victim as above, acquired 2 million won from the Busan Bank account (Account Number: J) in the name of the Defendant’s father as a prior loan interest from the victim.

2. Around February 25, 2015, the Defendant called the above victim BM at the French site on February 23, 2015, and falsely stated that “a loan fee must be remitted to the head of the lending company upon obtaining the approval of the loan. If the head of the office BN deposits KRW 1,493,00 in the Busan Bank account (Account Number: BO) in the name of the head of the office, he/she will loan KRW 50 million on the following day.”

However, even if the defendant received money from the victim as a loan fee, he did not have the intention or ability to lend 50 million won to the victim.

On February 25, 2015, the Defendant, by deceiving the victim as above, obtained money from the victim through the Busan Bank account (Account Number: BO) in the name of BN from the Busan Bank account (Account Number) in the name of loan fee and obtained money from the victim.

3. On March 7, 2015, the Defendant: (a) called the said victim BM by phoneing the said victim’s Ba on the first place on March 7, 2015; and (b) filed a complaint with the said victim for fraud on the ground that the male living together with the second year is not married; (c) the Defendant ought to show that he was prepared for marriage with the intention to marry. On the face of doubt, the Defendant should also show that he was able to arrange for marriage. The Defendant made a false statement that the Defendant would be able to pay back at the time of the purchase of the tugboat.

However, the defendant is issued a credit card from the victim.
