1. Of the judgment of the court of first instance, with respect to the Plaintiff regarding the Nam-gu, Ulsan Metropolitan City, Ulsan Metropolitan City KRW 30,120,081 and its related amount on July 31, 2016.

1. Facts of recognition;

A. The Plaintiff, a juristic person running a car rental business and brokerage business, has been keeping the leased vehicles in the Plaintiff’s exclusive parking lot located behind the building on the land level B in Ulsan-gu, Ulsan-gu, Seoul Metropolitan Government (G household stores are located, and thus, they are located behind the building).

B. (1) The Plaintiff’s exclusive parking lot consists of a space where 3 to 4 vehicles with the height of 3 to 4 vehicles, such as the first floor floor of the building above (hereinafter “ground parking lot”) and a space where vehicles with the same height as the first floor below the ground side of the parking lot below the lower part of the parking lot below the ground side of the household store (hereinafter “instant parking lot”).

(2) The household store building is adjacent to C, which is a five-lane road across a width of about 3 meters. The instant parking lot is installed at the point where the access road adjacent to the said road, which is located adjacent to the said road, bypassing it from C, and the rapid down slope, which is connected to the last part of the said access road, is completed.

C. In the surrounding circumstances of the instant parking lot (1) from C to the instant parking lot, there was a low boundary line for vehicle traffic, and two sewage holess were installed at C edges abutting on both edges of the said boundary line.

(2) In front of the building of the household store, the building of the main complex is located on the first floor of the building in which J is located, and in the edge of the road adjacent to C in the upper complex building adjacent to C in the upper complex building of the said main complex building, two of the cross-section excellent sewage holes (hereinafter referred to as the “instant sewage hole”) are installed.

(3) The superior officers connected to the instant sewage treatment are designed to treat sewage of 20.4 meters at a maximum early 10m and 5.1m per hour on the basis of the strong frequency of 10 years.
