Reasons
Punishment of the crime
The defendant, as the representative director of corporation C in Jung-gu Seoul Metropolitan Government, is an employer who employs 30 full-time workers and runs the business of operating the Fluice Center while operating the said company.
The Defendant, while working in the company from August 17, 2009 to December 22, 201, did not pay KRW 10,473,306, total amount of wages and retirement allowances to the said company, including KRW 1,658,547, Oct. 10, 201, as well as KRW 10,473,306, as well as KRW 30,61,741, total amount of wages and retirement allowances to the total nine workers, within 14 days from the date of retirement without agreement on the extension of the due date between the parties, as shown in the attached list of crimes.

Article 109(1) and Article 36 of the Act on the Guarantee of Workers' Retirement Benefits (which refers to unpaid wages), Articles 31 and 9 of the former Guarantee of Workers' Retirement Benefits (wholly amended by Act No. 10967, Jul. 25, 201) of the Act on the Protection of Workers' Retirement Benefits, and Articles 31 and 9 of the former Act on the Guarantee of Workers' Retirement Benefits (which refers to unpaid retirement allowances) were indicted by applying the Labor Standards Act on the unpaid retirement allowances among the facts charged. However, the Act on the Guarantee of Workers' Retirement Benefits was enacted by Act No. 7379, Jan. 27, 2005 and Article 34 of the Labor Standards Act enters into force on December 1, 205, and at the same time, Article 34 of the Labor Standards Act stipulates that “The retirement benefits system that an employer pays to a retired employee shall be governed by the Act on the Guarantee of Workers' Retirement Benefits after the date of entry into force of the Guarantee of Workers' Retirement Benefits.
