Reasons
Punishment of the crime
The defendant of "2017 Highest 1885" is a person in the name of the E Welfare Center for the Aged who is actually operated by the victim C (54 tax) in Youngcheon-si, Gyeongcheon-si.
1. The Defendant, while keeping 25,460,049 won of public funds, such as medical care benefits, etc. at the EO Welfare Center in the name of the Defendant for the victim, withdrawn 6 million won from the cash withdrawal machine on January 26, 2017, 4 million won was delivered to the victim, and the remainder of 2 million won was arbitrarily used for the personal purpose, as indicated in the attached list of crimes, and embezzled the victim’s property at will by withdrawing 4,60,000 won over five times in total as indicated in the attached list of crimes.
2. The Defendant embezzled the victim’s property by refusing to return the remainder of 22 million won without good cause while he/she was in custody of the EM’s medical care benefit of KRW 44 million for the victim, which was remitted to the Agricultural Cooperative Account (F) in the name of the Defendant. On February 21, 2017, the Defendant received a request from the injured party to return the full amount of said money from the injured party.
The defendant of "2017 Highest 2588" is an operator in the name of the E Welfare Center for the Aged that the victim C actually operates in Youngcheon-si D.
While the Defendant was transferred to the Agricultural Cooperative (F) account in the name of the Defendant, which was operated by the injured party, and deposited an amount equivalent to KRW 23,585,040 on November 25, 2016, withdrawn KRW 23,500,000 from the French land on November 25, 2016, and returned KRW 230,000 from the French land on the 26th day of the same month to the victim and arbitrarily used the remainder 9,740,000 won for living expenses, etc.
Accordingly, the defendant embezzled the victim's property.
The defendant of "2017 Highest 3711" is an operator under the name of "E Elderly Welfare Center" operated by the victim C in Youngcheon-si D.
