Reasons
Punishment of the crime
[Criminal Justice] On August 12, 2016, the Defendant was sentenced to six months of imprisonment for larceny at the Seoul Southern District Court, and completed the execution of the sentence on November 20, 2016 at the Seoul Southern District Court. On April 18, 2018, the Seoul Southern District Court sentenced eight months of imprisonment for night building intrusion, larceny, etc., and completed the execution of the sentence in the female prison on October 15, 2018.
【Criminal Facts】
1. A theft Defendant: (a) around 05:00 on April 26, 2019, in Gangdong-gu Seoul Metropolitan Government, and in front of the male water surface room, creshed the surrounding surveillance neglected; (b) was stolen with a string card, one lot card, one lot of modern card, one lot of card, one lot of Korean card, and one lot of driver’s license, and 35,000 won at the market price, which are located in the vicinity of victim D.
2. Computer etc. fraud or violation of the Specialized Credit Financial Business Act;
A. At around 05:31 on April 26, 2019, the Defendant settled KRW 11,000 by inserting the stolen PC card from “GPC bank” operated by the Victim F in Gangdong-gu Seoul, Gangdong-gu, by means of inserting it into an unmanned settlement machine, thereby recognizing information on the said PC card at the settlement machine, and putting it over. Accordingly, the Defendant, without authority, obtained pecuniary benefits equivalent to KRW 11,00,00 by inputting the PC information and used the stolen PC card. Around 07:52 on April 26, 2019, the Defendant purchased 40,000 won by inserting the PC card in the name of the victim I working in Gangdong-gu Seoul Metropolitan Government, with the recognition of 40,00 won by means of the PC’s unmanned settlement machine in the name of the victim I, as described in the above paragraph 1 of the same Article.
Accordingly, the defendant, without authority, entered information on the physical card and acquired 8,400 won and used the stolen physical card.
