The grounds of appeal are examined.

For the reasons indicated in its holding, the lower court reversed the conviction portion of the first instance judgment and sentenced the Defendants not guilty, on the ground that the charges of this case against the Defendants constituted a case where there is no proof of crime, and dismissed the prosecutor’s appeal against the acquittal portion of the first instance judgment.

The judgment below

Examining the reasoning in light of the relevant legal principles and records, the above judgment of the court below is justifiable. In so doing, contrary to the allegations in the grounds of appeal, the court below did not err by misapprehending the legal principles regarding intentional preparation of false official document, deception of fraud and deception of fraud, or by misapprehending the bounds of free conviction due to violating logical and empirical rules, thereby adversely affecting the conclusion of the judgment.

Therefore, all appeals are dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
