1. Revocation of a judgment of the first instance;

Reasons
1. Details of the disposition;
A. On May 13, 2014, the Plaintiff’s network B (CB; hereinafter “the deceased”) was employed as a contact and an official watch (on duty) for the development of the Honam Forest integrated development of the Honam Forest Corporation on May 13, 2014, and thereafter, it was working on the site of “the construction of an island (openway) where the same company is going to find” (hereinafter “the instant construction”).
B. On May 28, 2014, at around 11:30, the Deceased died of cerebral cerebrovascular and her Hemovascular heart disease due to cerebral dystrophism on the 2nd floor of the pentth floor of the instant construction site, when he/she was performing the work of installing a tamper on the pentth floor of the penta, which is located in the instant construction site, and when he/she was under treatment after being transferred to a scoperum hospital located in the Yacheon-si, and was in the process of treatment.

On July 4, 2014, the Plaintiff asserted that the deceased died from an occupational accident, and claimed for the payment of survivors’ benefits and funeral expenses to the Defendant. However, on August 5, 2014, the Defendant rendered a disposition rejecting the payment of survivors’ benefits and funeral expenses (hereinafter “instant disposition”) on the ground that there is no proximate causal relation between the instant accident and the deceased’s work.

2. Whether the disposition is lawful;
A. During the construction period of the instant construction work, the Deceased was commuting to and from the work site located on islands daily, and the Deceased’s death was eventually caused by an accident of this case, where the Deceased’s work was performed while driving away from the construction completion due to a tension and uneasiness, exposed to strong solar energy on the roof of a sloping photo without any particular safety facilities. The stress on the tension and uneasiness arising from the above poor working environment overlaps, thereby affecting the normal function of the Deceased’s cerebrovascular or cardio-cerebrovascularscular.
