All prosecutions against the Defendants are dismissed.
Reasons
1. The summary of the facts charged is the secretary general of the E organization “E organization” as a non-profit organization for cultivation from the second half of 2016 to July 19, 2017. Defendant D took charge of the management of members and membership fees, application for subsidies, and enforcement of subsidies. Defendant D took charge of the overall management of the E organization as the vice-chairperson of the E organization and the production team leader from March 2017 to July 19, 2017. Defendant C took charge of various events from March 2017 to May 2017 by joining the E organization as a regular member. Defendant B took charge of various events as the head of the event team of the E organization from March 2017 to May 2017. Defendant B joined the E organization in the second half of 2015.
Defendant
On July 19, 2017, the victim F, who is the chairperson of the E organization, forced withdrawal from the E organization on or around July 21, 2017, the defendant A established the "E organization Emergency Countermeasures Division" G, and the defendant D drafted 62 persons, including the members of the existing E organization G and the public officials in charge of the distribution of the viewing farming stock and the H, who are in charge of the support of the city subsidy of the E organization, to the above G.
1. Defendant A
A. On July 21, 2017, at around 16:32, the Defendant: (a) specified the victim on the E Organization Emergency Countermeasures G bulletin board; (b) sent the amount of tuition fees to lower the amount without any prior notification; and (c) sent the amount of tuition fees to the Plaintiff without any notification at the time of the payment of tuition fees to the Plaintiff, and (d) posted a notice stating, “I have received any further consideration than the content determined at the time of Busan only by submitting it to the Plaintiff.”
B. On August 12, 2017, the Defendant was G in the E-group Emergency Countermeasures Division around 12:27.
