Reasons
Punishment of the crime
[2019 Highest 2089] The defendant is a member of the homeland reserve forces belonging to Kimhae-si.
1. On April 15, 2019, the Defendant did not receive the said training without justifiable grounds, even though he directly received a notice of a call for training in the name of the third unit commander of the Army 5870 unit units of the Army around April 5, 2019, that “Around April 15, 2019, the Defendant was receiving eight hours of basic training (16 year carried forward training) conducted by the head of the Kimhae Reserve Forces training site.”
2. 3. On April 17, 2019, the Defendant, who was absent from the reserve forces training, did not undergo the said training without justifiable grounds, even though he received a notice of convening a training call in the name of the third unit commander of the Army 5870 unit commander at the Army around April 5, 2019, which was directly conducted at the training site of the Kim Sea Reserve Forces around April 17, 2019.
4. On April 18, 2019, the Defendant, who was absent from the reserve forces training, did not undergo the said training without justifiable grounds, even though he received a notice of convening a training call in the name of the third unit commander of the Army No. 5870 unit in the Army around April 18, 2019, which was directly conducted at the training site of the Kim Sea Reserve Forces on or around April 18, 2019, from the injury or disease C belonging to the Kimhae-si branch of the 5870 unit in the Army.
