1. The Defendant (Counterclaim Plaintiff) paid KRW 45,570,363 to the Plaintiff (Counterclaim Defendant) and its related amount from January 29, 2016 to November 10, 2017.
Reasons
A principal lawsuit and a counterclaim shall be deemed simultaneously.
1. The Plaintiff, from around 2008 to October 2015, has supplied the Defendant with and sold polypasium, which is the paints of the pentum (Flamed Flamer).
(1) As to the Plaintiff’s claim against the Plaintiff for the remainder of KRW 142,615,00 (the remainder of supply as of October 2015), the Plaintiff’s claim for reimbursement of damages equivalent to KRW 142,615,00 (the remainder of supply as of October 2015), the Defendant asserted that the amount of the Plaintiff’s claim and the amount equivalent to the amount of the Plaintiff’s claim are offset against the remainder of the amount of the damages claim and the amount of the damages incurred by the Plaintiff from December 2014, and the amount of the damages incurred by the Plaintiff as of KRW 142,615,00 (the remainder of supply as of October 2015) and the amount of the damages incurred by the Plaintiff as of KRW 142,615,99,998 (the remainder of supply as of October 249, 2015).
2. There is no dispute between the parties that the Plaintiff supplied the Defendant with polybes equivalent to the total supply amount of KRW 142,615,00,00, to determine the claim of the principal lawsuit on October 2015.
(2) The defendant is obligated to pay 142,615,00 won for the above goods unless there are special circumstances to the plaintiff. The defendant is obligated to pay 142,615,000 won for the above goods.
3. According to the result of the Defendant’s request for the appraisal of defects against C and the result of each fact-finding with respect to the Defendant’s defense and counterclaim, the main causes of defects, such as stuffing, etc., occurred due to defects, such as the fact that the Plaintiff’s construction of the light speed of polybes supplied by the Plaintiff was erroneous, and that the Defendant also manufactures quality and manufactures such as manufacturing in sequence after the product test.
