The defendant shall be innocent.
Reasons
1. On July 29, 2011, the Defendant: (a) purchased KRW 38 million from the importer “F in purchasing KRW 1 of BMW35i High Vehicle E (2008 Form) from Nam-gu Incheon Metropolitan City, in purchasing KRW 38 million from the importer “F; (b) obtained a loan of KRW 49.9 million from the Hyundai Capital Capital; and (c) purchased the said vehicle.
After purchasing the said vehicle, the Defendant tried to operate the said vehicle as a siren but did not intend to do so, and as a result, there was no person seeking to purchase the said vehicle, other than a regular imported vehicle, and thus, it was difficult to dispose of the said vehicle, the Defendant intentionally paid the vehicle accident, and recovered the purchase cost for the said vehicle by receiving insurance money from the insurance company for the disposal of the vehicle, and intended to dispose of the said vehicle.
1. On November 3, 201, at around 22:11, the Defendant received the report of the accident in the victim’s East Fire Maritime Insurance, as it was a traffic accident in which the passenger car operating the said BMW335i E (2008 Form) was trying to avoid exceeding the central line in order to avoid crossing the road while driving the said BMW35i E (2008 Form), while driving the car at a single distance near the mother basin located in the Daegu-si, Suwon-gu. In addition, the Defendant received the report of the accident in the victim’s East Fire Maritime Insurance (State) as it was a traffic accident.
However, the fact was that the defendant driven the above vehicle in order to pay the insurance money and caused the accident intentionally to the telegram.
As above, the Defendant, by deceiving the victim of the same fire insurance (state), received KRW 13.8 million from the victim, and acquired it by deceptiveation.
2. On February 4, 2013, around 01:50, the Defendant received an accident report from the victim AXA damage insurance (State) as if it was a traffic accident at the right side of the instant vehicle while driving the said vehicle, even though it was possible to take out tobacco from the fluench in the right side of the fluench, and fluencing the road due to an rapid fluencing of the fluenc in India, and it was a traffic accident at the right side of the road.
