Punishment of the crime

Defendant

A is the owner and captain of H (9.77 tons, inshore net, and five crew on board) of a military shipment H (9.77 tons, five crew on board). Defendant B is the owner and captain of the Gun shipment I (12 tons, inshore net, five crew on board). Defendant C is the captain of the Gun shipment J (13 tons, four crew on board). Defendant D is the owner and captain of the Gun shipment K (12 tons, inshore net, five crew on board) and the captain of the Gun shipment K (5 crew on board). Defendant E is the captain of the Gun shipment L (13 tons, inshore net, five crew on board). Defendant F is the captain of the Gun shipment M (17 tons, inshore net, five crew on board).

No one shall manufacture, sell or load fishing implements, other than the fishing implements licensed, permitted, approved or reported under the Fisheries Act, and fishing implements, the use of which is prohibited as prescribed by the Fishery Resources Management Act.

Nevertheless, at around 11:00 on March 29, 2013, the Defendants: (a) carried the fishing gear used for offshore-type fishing at a new harbor located in the Haak-gun, Chungcheongnam-gun; (b) carried the fishing gear, which is prohibited from being used in a way that kids are attached to a fixed framework to ensure that kids are not broken up; and (c) carried the fishing gear, the use of which is prohibited by attaching a kids to the bottom of the fixed framework, without attaching a kids to the chain, into each Defendants’ fishing vessel.
