Reasons

Punishment of the crime

The defendant is a person in charge of the business management of the D Co., Ltd. in Gangseo-gu Seoul Metropolitan Government Btel C, who runs a construction business by employing five full-time workers.

1. When a worker dies or retires, the employer in violation of the Labor Standards Act shall pay the wages, compensations, and other money or valuables within fourteen days after the cause for such payment occurred;

Nevertheless, the Defendant did not pay KRW 5,149,940 of F retirement pay from June 30, 2014 to December 31, 2017 at the same place of business without agreement between the parties to the extension of the due date within 14 days from the date of retirement, which is the date of the occurrence of the cause for payment.
