A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for a period of three years from the date this judgment becomes final and conclusive.

Punishment of the crime

around March 2016, the Defendant became aware of the Victim G (V) who works at the seat of the Htel located in the Gangseo-gu Seoul Metropolitan Government, and was living in the victim’s residence in Gangseo-gu Seoul Metropolitan Government Htel B 1012 from October 7 to January 14, 2017 of the same year.

On January 14, 2017, the Defendant received a separate notice from the injured party, and had the victim find the victim's residence around the 18th day of the same month when the victim did not move to himself.

1. On January 18, 2017, around 05:12, 2017, the Defendant infringed upon the residence of the said victim: (a) installed an entrance safety device before the said victim’s residence and opened the entrance door to the victim; (b) however, the Defendant was refused to return to the victim; and (c) did not report to the victim to 112; and (d) installed a defect in the entrance entrance and exit safety device at the entrance; and (c) went into the victim’s residence after destroying the entrance and exit safety device.

2. 특수 감금, 특수 상해 피고인은 제 1 항 기재와 같은 일시, 장소에서 제 1 항 기재와 같이 피해자의 주거지에 들어간 후 피해자가 자신을 피하고 112에 신고를 하였다는 이유로 화가 나 피해자의 머리채를 낚아챈 후 주먹과 발로 피해자의 얼굴을 수회 때리고, 그 곳 주방에 있던 위험한 물건인 식칼( 전체 길이 32cm, 칼날 길이 20cm) 을 꺼 내 피해자의 가슴을 향해 겨눈 채 “ 오늘 너를 죽여주겠다” 고 말하며 손으로 피해자의 머리를 때리고, 이에 피고인을 피해 출입문을 열고 밖으로 나가려는 피해자의 후드 티를 잡아 당겨 안으로 끌고 들어와 침대 위에 눕힌 후 “112 신고를 취소하라” 고 요구하면서 밖으로 나가지 못하게 하고, 피해자로 하여금 112 신고를 받고 그곳에 출동한 경찰관에게 문을 열어 주지 않도록 요구하고 “ 그냥 돌아가라 ”라고 말하도록 하는 등 약 20분 간 밖으로 나가지 못하게 하였다.
