A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
On July 2012, the defendant was recommended to buy insurance from the victim C (V) who is an insurance solicitor and became aware of the victim's insurance coverage. While the defendant was able to gather the military register of the defendant, the victim was dissatisfied with this problem.
1. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (Kameras and photographing);
A. At around 22:50 on December 24, 2012, the Defendant taken pictures of the victim’s body against the victim’s will by photographing the victim’s balone by using the cell phone apparatus owned by the Defendant against the victim’s will after having sexual intercourse with the victim at a multi-household room where D located in Yanan-si, Yan-si.
B. At around 11:00 on May 201, 2013, the Defendant taken pictures of the victim’s body against the victim’s will by taking pictures of sexual intercourse with the victim using his mobile phone devices owned by the Defendant following the victim, which could cause sexual humiliation or shame using a camera.
2. Suppression;
A. At around 13:30 on December 27, 2012, the Defendant made phone calls to the victim within the Defendant’s vehicle parked in the southnam-gu F (hereinafter referred to as the “Saecheon-gu”) and received property by sending money to the victim’s family members or their neighbors, namely, by receiving 1.580,000 won from the victim’s seat to the savings account in the name of the Defendant at the bar (G). In addition, if the Defendant did not send money to the victim, “I am, Chewing, and the insurance premium for theme fested. I am the entire amount of the insurance premium for theme. I am a large amount of money.” The Defendant received property from the victim’s family members or their neighbors as if he would transmit the sexually related video to the victim’s family members or people.
B. On January 30, 2013, the Defendant called the victim at an insular place around 15:00.
