1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. The following facts do not conflict between the parties, or can be acknowledged in full view of the whole purport of the arguments in the statements in Gap evidence 1, evidence 2-1, evidence 2-3, evidence 4, evidence 5-1, evidence 5-2, evidence 7, evidence 8-1, 2, evidence 9, evidence 1, evidence 3-1, evidence 3-4, and evidence 4.
피고는 2013. 3. 6. 별지 목록 기재 건물(이하 ‘이 사건 건물’이라 한다)의 소유자인 CD과 사이에 이 사건 건물의 1층 중 별지 도면 표시 ㉠, ㉡, ㉢, ㉣, ㉠의 각 점을 차례로 연결한 선내 부분 약 40㎡(이하 ‘이 사건 점포’라 한다)에 관하여 임대차보증금을 20,000,000원, 차임을 월 1,700,000원(부가가치세 별도), 관리비를 월 300,000원(부가가치세 별도), 임대차기간을 2012. 11. 1.부터 2017. 10. 31.까지로 하는 임대차계약(이하 ‘이 사건 임대차계약’이라 한다)을 체결하고 이 사건 점포에서 E이라는 상호로 한식 음식점을 운영하고 있으며, 이 사건 임대차계약 중 이 사건 관련 내용은 다음과 같다.
Article 6 (Cancellation of Contracts and Penalty)
2. If “B” (Defendant) falls under any of the following subparagraphs, “B” shall lose the benefit of time and “B” shall have a grace period of not less than seven days to “B” and may terminate or rescind this contract where there is no implementation after giving a peremptory notice to “B”.
(i) When the rent is overdue for at least two months;

The Defendant did not pay the CDs KRW 2,20,00 among the rent and management expenses for Apr. 2, 2013, KRW 200,00 among the rent and management expenses for Oct. 2013, and KRW 200,000 among the rent and management expenses for Nov. 2013, 203, KRW 2,200,000 among the rent and management expenses for Dec. 2, 2013, KRW 2,200,00, KRW 2,200,000 for the rent and management expenses for Jan. 2014, and KRW 2,200,000 for the rent and management expenses for Mar. 20, 2014, KRW 2,200,200 for the rent and management expenses for Jun. 20, 2014, KRW 200 for the rent and management expenses for Aug. 20, 2014, KRW 300.
C. On July 7, 2014, the Plaintiff owned CDs.
