1. 특수상해 및 특수재물손괴 피고인 A은 2018. 10. 24. 02:19경 제주시 C에 있는 D 식당 내에서 술을 마신 상태로 다른 손님과 말다툼을 하던 중 피해자 E(33세)로부터 제지를 당하자 일단 위 식당 밖으로 나왔다가, 그 무렵 식당 밖으로 나온 위 E가 위 식당 맞은 편에 있는 피해자 F가 운영하는 G편의점 안에 있는 것을 발견하고, 위 편의점 앞 노상에서 위 E에게 욕설을 하면서 흥분하여 같은 날 02:23경 위 편의점 앞 노상에 놓여있던 위험한 물건인 대리석을 들고 위 편의점 문 앞까지 달려가 위 대리석을 편의점 안으로 던져 E의 무릎을 맞추고 위 E의 몸을 맞고 튕긴 대리석이 위 편의점 진열대와 바닥 타일을 충격하게 하여 진열대 모서리 부분이 파손되고, 바닥 타일에 흠집이 가게 하였다.
