1. The defendant A shall be punished by imprisonment for eight months;

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[Attachment] Defendant B was sentenced to a suspended sentence of one year of imprisonment for embezzlement on October 14, 2010 at the Seosan Branch of the Daejeon District Court, and the judgment became final and conclusive on October 22, 2010.

[2012 Highest 1035] Defendant A was appointed as the head of the G fishing village fraternity and the Chairperson of the Emergency Countermeasure Committee (hereinafter referred to as “non-performance”) of the G fishing village fraternity of the Do-do Fisheries Cooperatives G (71 members of the G fishing village fraternity) on April 5, 2012, and Defendant A was appointed as the head of the G fishing village fraternity in violation of the provisions of the G fishing village fraternity’s articles of association, and the term “the head of the division shall be directly elected at the general meeting.” Defendant A was replaced by the head of the G fishing village fraternity of the G fishing village fraternity on May 16, 2012 and was engaged in the business of the head of the G fishing village fraternity of the G fishing village fraternity. Defendant B was active as the above non-performance member, and Defendant A was presumed to be the head of the G fishing village fraternity, and then Defendant A took part in the activities, such as recording or copying the contents of meetings designated by Defendant A as the executive secretary of the G fishing village fraternity.

On May 17, 2012, Defendant B, a private user or private company, prepared and printed out 71 copies of the notice stating that “G fishing village fraternity A and 13 members including J, based on the provisions presented in the articles of incorporation and the contents delegated by the general assembly, shall be elected as the head of the fishing village fraternity and the representative of the fishing village fraternity,” and then delivered it to Defendant A, and Defendant A signed and sealed the official seal of the former head of the G fishing village fraternity, which had been kept by the former head of the G fishing village fraternity, to the G fishing village fraternity management committee, subsequent to the resignation of the former head of the G fishing village fraternity, and distributed the above notice to 71 members of the G fishing village fraternity, respectively.
