The judgment of the court below is reversed.

Defendant shall be punished by a fine of KRW 10 million.

The above fine shall not be paid by the defendant.

1. The sentence imposed by the court below on the defendant (eight months of imprisonment) is too unreasonable.

2. In order to ensure the safety of road traffic and prevent danger, it is necessary to strictly punish the crime of refusing to take a drinking test, and the defendant has been punished several times due to drinking or non-licensed driving. However, even though the defendant is under suspension of the execution due to drinking or non-licensed driving, the fact that there is a high possibility of criticism for the crime of this case without being able to do so is disadvantageous to the defendant.

그러나 피고인이 이 사건 범행을 인정하고 반성하면서 향후 재범하지 않을 것을 다짐하고 있는 점, 음주 후 3 차로에서 시동을 켠 채 정 차 하여 자다가 적발되어 교통사고 발생의 위험이 현실화되지는 아니한 점, 이 사건으로 약 2개월 이상 구금되어 있으면서 음주 운전, 무면허 운전 등의 반복에 따른 처벌의 심각성을 충분히 깨달았을 것으로 보이는 점 등과 그 밖에 이 사건 변론에 나타난 피고인의 연령, 성 행, 환경, 범행 경위, 방법, 재범 가능성, 범행 후의 정황, 전과 관계 등 이 사건 양형의 조건이 되는 여러 사정을 종합해 보면, 원심이 피고인에게 선고한 형은 무거워서 부당하다.

3. As such, the defendant's appeal is with merit, and the judgment of the court below is reversed pursuant to Article 364 (6) of the Criminal Procedure Act, and the defendant's appeal is again decided as follows.
