A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant committed the following crimes under the state that he or she lacks the ability to distinguish things and make decisions due to the efficiencies.

피고인은 피해자 B(여, 63세)와 같은 동네 주민으로, 2019. 8. 20. 08:50경 피고인이 작물을 심어왔던 여수시 C에 있는 피해자의 집 부근 공터에 피해자의 요청으로 정자 및 운동기구 설치 공사가 시작되자 이를 항의하기 위해 피해자 집에 찾아가 대문을 발로 찼으나 아무런 인기척이 없자 다시 피고인의 집으로 가 등유가 들어있는 소주병과 일회용 라이터(증 제1호)를 가지고 피해자의 집에 불을 지를 목적으로 다시 피해자 집으로 찾아가 대문을 열고 집 안으로 들어간 다음 작은 방에 있는 침대 모서리에 위 소주병을 내리쳐 깨뜨려 등유를 그 곳에 쏟은 다음 일회용 라이터로 불을 붙여 그 불길이 피해자의 집 전체에 번지게 하여 소훼하려고 하였으나 위 공사를 하던 인부가 불길을 보고 집 안에 들어가 그 불길이 피해자의 집 벽면, 천정 등에 옮겨 붙기 전에 물을 끼얹어 불을 끄는 바람에 미수에 그쳤다.

Accordingly, the defendant was trying to fire a structure used as a residence by setting fire to and from the victim.
