A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On June 8, 2007, the Defendant is a person who has been issued a summary order of a fine of five million won or more due to a violation of the Road Traffic Act (driving) at the Suwon District Court on the grounds of a violation of the Road Traffic Act, or a fine of five million won or more due to a violation of the Road Traffic Act (driving) at the Suwon District Court on July 3, 2013.

On July 26, 2014, at around 02:45, the Defendant driven C’s automobile while under the influence of alcohol content of 0.139% from the roads near the Suwon-dong community service center in Suwon-gu to the roads in front of the same Gu.

2. At around 02:45 on July 26, 2014, the Defendant: (a) received D-owned cargo vehicles that were parked while driving the said Saturday car under the influence of alcohol concentration of 0.139% on the front of Suwon-si B, Suwon-si; (b) caused a traffic accident involving a vehicle in the E’s ownership, and (c) caused F, who was going in company with the said Saturday car, to the effect that “I would like to be able to pay a fine or pay a fine at present, because I would have driven, I would like to have the said F act as the driver and to have the Defendant undergo the police investigation on behalf of the Defendant.”

3. Although a person who has taken over a motor vehicle registered in violation of the Automobile Management Act applies for the registration of transfer of ownership of the motor vehicle to the Mayor/Do governor, the defendant did not apply for the registration of transfer without justifiable grounds even though he/she has taken over the motor vehicle from a Buddhist person on May through June, 2014.

4. On July 26, 2014, the Defendant violated the Guarantee of Automobile Accident Compensation Act: (a) operated the said vehicle without mandatory insurance from the YY-dong community service center nearby the same Gu to the roads adjacent to the same Gu.
