Defendant
A shall be punished by imprisonment with prison labor for ten months, and imprisonment with prison labor for six months.
However, the Defendants are subject to this.
Reasons
Punishment of the crime
1. From November 6, 1999 to April 9, 2012, Defendant A purchased a total of nine insurance policies, including Linna Social Health Insurance, etc.
From October 22, 2011 to November 11, 2011, the Defendant hospitalized the E Hospital 621, each of which was located in Kimhae-si, with an identification in detail, on November 11, 2011, and filed a claim for the payment of insurance proceeds on October 14, 201, on the ground that the Defendant was hospitalized for the above disease, respectively, on the victim's oriental life, the victim's KDB life, the victim's modern sea, and on November 14, 201.
However, even though the above disease is 21 days without necessity of hospitalization, the Defendant was hospitalized in the house with the idea of acquiring insurance money under the pretext of hospital treatment expenses, and even there was no fact of faithfully receiving hospital treatment, such as going out and going out during the period of hospitalization, and living outside the hospital.
As such, the Defendant, by deceiving the victims, received the total sum of KRW 4,460,00 from November 14, 201 to December 21, 201, from the victims.
In addition, the Defendant, from around that time to October 2, 2012, obtained the total sum of 38,188,055 won from victims on the same several occasions as the attached crime list (A), as shown in the attached Table of Crimes (A).
2. The Defendant B purchased a total of eight insurance policies, including Korean-style life, from January 21, 2002 to December 10, 2008.
From December 14, 201 to January 16, 2012, the Defendant was hospitalized in E Hospital 621, E Hospital 621 located in Kimhae-si, Kim Jong-si, the right satise satise satise satise satise satise satise satise satise satise satise satise satise satise satise satise satise satch, on January 16, 2012; on January 17, 2012; on January 18, 2012; on January 19, 2012, the Defendant received insurance proceeds from operation and hospitalized treatment from the above disease respectively.
