1. The Defendant shall pay to the Plaintiff KRW 43,594,00 and the interest rate of KRW 15% per annum from January 10, 2019 to the day of complete payment.

1. Facts of recognition;

A. The Plaintiff is a company manufacturing and supplying medical appliances, medical aids, etc., and the Defendant is an individual entrepreneur who engages in wholesale and retail business, such as medical appliances and aids, under the trade name of “C”.

B. Around July 2016, the Plaintiff entered into a contract with the Defendant to supply goods, such as medical appliances, to the “C” operated by the Defendant, and the price for the goods was to be paid to the Plaintiff’s bank account (Seoul Bank D) at the beginning of four months after the date of supply of goods.

C. From July 5, 2016 to April 27, 2017, the Plaintiff supplied the Defendant with goods, such as medical appliances.

The Defendant deposited part of the goods at the beginning of each month from November 2016, which was four months after the above contract, to the Plaintiff, but did not pay the Plaintiff the goods amounting to KRW 43,594,00 on the ground of aggravation of the medical market situation.

According to the above facts of determination, the Defendant is obligated to pay to the Plaintiff the amount of KRW 43,594,000 payable to the Plaintiff and damages for delay calculated at the rate of 15% per annum from January 10, 2019 to the day of full payment, which is the day following the delivery of a copy of the complaint of this case.

3. In conclusion, the plaintiff's claim of this case is reasonable, and it is so decided as per Disposition.
