1. The Plaintiff is one of 8324 square meters in Seongbuk-gu Seoul, Seongbuk-gu.

Facts of recognition

On July 14, 1975, I acquired ownership of the Seongbuk-gu Seoul Metropolitan Government H large 8420 square meters (hereinafter “the site before the instant partition”).

In around 1977, J apartment operation and Nadong (each underground floor, 11th floor, and 132 households) were newly constructed on the ground before the instant partition, and around 1978, 17 separate stores (No of subparagraphs 1 through 18 and 12) with the size of 17th basements below the ground was newly constructed on the ground before the instant partition.

On December 27, 1978, the Plaintiff purchased No. 16, 27.2729 square meters (8 square meters, 2bbebs, 5 square meters) among the instant aggregate buildings from I, and completed the registration of ownership transfer on August 16, 1978, and owns it until now.

Since the above J apartment and the instant condominium were newly constructed before the enforcement of the Act on the Ownership and Management of Aggregate Buildings (amended by April 10, 1984, the enforcement of April 11, 1985, hereinafter “the Act”), the registration of the right to a site was not completed at the time of registration of ownership. Since the enforcement of the Act on the Ownership and Management of Aggregate Buildings, the registration of the right to a site was completed as of December 31, 1985 with respect to J apartment as of December 31, 1985, and the registration of the right to a site was completed on October 2, 1986 for the 16 persons among the sectional owners of the instant aggregate buildings other than the Plaintiff.

The ratio of the share of a site to the area of the whole site transferred from I by 16 persons holding a sectional ownership of the instant condominium building is average 3.153/8420, and the shares remaining I in the future without completing the registration of a site ownership among the land before the division of this case are 21.97/8420.

On June 19, 2013, the instant site was divided into H large 8,324 square meters (hereinafter “instant site”) and K large 94 square meters and L large 2 square meters.

I died on May 23, 1985 and jointly succeeded by the Defendants, and according to the former Civil Act (amended by Act No. 4199, Jan. 13, 1990).
