1. The Defendant shall pay to the Plaintiff KRW 27,00,000 and the interest rate of KRW 15% per annum from November 7, 2015 to the date of complete payment.

In full view of the purport of the argument in Gap evidence No. 1, the plaintiff lent KRW 27,00,000 to the defendant on August 11, 2009, and the defendant issued a promissory note with the maturity of the plaintiff and the issuer as the defendant on the same day in order to guarantee its payment.

According to the above facts of recognition, the defendant is obligated to pay to the plaintiff 27,000,000 won and damages for delay at the rate of 15% per annum under the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings from November 7, 2015 to the day of full payment, which is the next day from the delivery date of a copy of the complaint of this case claimed by the plaintiff

(1) The court below held that the plaintiff's claim is reasonable, and the plaintiff did not appear at the date of pleading after submitting a written order for payment seeking the rejection of the plaintiff's claim formally. This decision is delivered with the assent of all Justices.
