The defendant shall be innocent.

1. Around June 2010, the Defendant used mountainous districts for purposes other than afforestation, etc. or changed the form and quality of mountainous districts to use mountainous districts for purposes other than afforestation, etc., by cutting off the words and trees on the 15 square meters area in part (hereinafter “the mountainous district in this case”) and the trees on the 15 square meters area in the above mountainous district, which were connected in sequence with the above mountainous district in order to set farming houses in neighboring farmland without obtaining permission from the Administrator of the Korea Forest Service.

As a result, the Defendant diverted mountainous districts without obtaining permission for mountainous district conversion.

2. As evidence consistent with the facts of this case, E/F’s statements, business trip reports (No. 13-16 of the Investigation Record), each A, G illegal photographs (No. 11, 15 of the Investigation Records), damaged photographs (F, No. 2 of the Investigation Records No. 153-157 of the Investigation Records), aerial photography in 2009 (F, No. 153-157 of the Investigation Records), aerial photography in 2010 (up to the earth), field photographs (up to the earth), (up to the earth), (upto the earth), (upto the form and quality), (up to the earth), (up to the form and quality change), (up to the investigation records), (up to the 3rd decision No. 2007Kahap406 of the Seoul Northern District Court Decision 2007Kahap406 of the Investigation Records, (up to the earth), and copies of examination records of appraiser H are evidence that correspond to each of the facts of this case.

According to the evidence submitted by the Prosecutor, F and E were examined with respect to each statement of F and E, and F and E, around May 2010 to investigative agencies, the Defendant directly supervised the work, removed the natural ditches, removed the waterway, removed the natural ditches, and removed the tree roots.
