1. The Plaintiff:
A. Defendant B: 152,00,000 won and 15% per annum from March 25, 2019 to May 31, 2019;
Reasons
1. Facts of recognition;
A. On June 21, 2016, Defendant C entered into a contract under which the construction of a newly built multi-household E-based housing (hereinafter “instant multi-household housing”) was awarded to D (hereinafter “instant contract for multi-household housing”). Defendant C, a fraud of Defendant C, entered into a contract on November 4, 2016, under which the construction of the new construction of the Dongdaemun-gu Seoul Metropolitan Government F Multi-household housing (hereinafter “instant F Multi-household”) was awarded to D (hereinafter “instant contract for multi-household housing”); and, in combination with the instant multi-household housing, the instant contract for each of the instant contracts was concluded.
B. On September 23, 2016, the Plaintiff entered into a subcontract with D to accept KRW 152,00,000 for the structural part of the instant E-Newly constructed multi-household housing (hereinafter “instant subcontract to multi-household housing”). On November 2016, the Plaintiff entered into a subcontract with D to accept KRW 250,000 for the structural part of the instant government-built multi-household housing construction (hereinafter “instant subcontract”) (hereinafter “F multi-household housing subcontract”), and to conclude the subcontract to accept KRW 250,00,00 for the structural part of the instant government-built multi-household housing construction (hereinafter “each of the instant subcontract”).
C. After that, the Plaintiff completed the structural construction in accordance with each of the instant subcontract agreements.
Defendant C obtained approval for the use of the instant E multi-household housing on May 22, 2017, and Defendant B obtained approval for the use of the instant F multi-household housing on December 21, 2017.
Defendant C sold all households of this case to G and H on September 28, 2017 and completed the registration of ownership transfer in the name of G and H after completing the registration of ownership transfer on May 26, 2017 for multi-household housing in this case.
Defendant B shall be the defendant B on 2018.
