A defendant shall be punished by imprisonment for not less than one year and six months.

The defendant shall complete a program for the treatment of sexual assault for 40 hours.

Punishment of the crime

[criminal history] On June 26, 2017, the Defendant was sentenced to one year to imprisonment with labor for a violation of the Narcotics Control Act at the Incheon District Court, and the judgment became final and conclusive on April 9, 2018.

1. Violation of the Narcotics Control Act;

A. On August 13, 2016, around 19:00, the Defendant, along with B at the trade influorial telephone located in the Gyeonggi-si in Gwangju-si, added the non-fluorial amblopon (one philopon; hereinafter “philopon”), into a single-use injection machine, and injected into the Defendant’s arms.

B. At around 02:00 to 03:00 on November 12, 2016, the Defendant put the non-phone volume into a one-time injection machine with B at the mutual influenite hotel rooms located in the Gangseo-gu Seoul Metropolitan Government Seodong, and melted it into the Defendant’s arms.

Accordingly, even if the Defendant is not a narcotics handler, he administered a philophone, which is a local mental medicine.

1. Violation of the Narcotics Control Act;

A. On June 27, 2016, the Defendant provided Mebacopon (one philoopon; hereinafter the same shall apply), administered 1) on June 27, 2016, the Defendant: (a) around 01:24 on June 27, 2016, in D hotel E heading room in Mapo-gu Seoul Metropolitan Government, and (b) on June 27, 2016, the volume of phiopon’s non-phones contained in a one-time injection machine to the above women before engaging in sexual intercourse with the above women (one-time “F”); and (c) around 01:27 on the same day, the Defendant also injected the volume of phiopon into a one-time injection machine, melting them with water, and then injected them into the Defendant’s left-hand bloodline.

2) On June 27, 2016, around 02:53, the Defendant: (a) completed the instant D hotel E’s act of influence with a female influorial sex; (b) had the said female fluorial volume of phiphones in a single-use injection instrument free of charge; (c) had the Defendant put the volume of phiphones in a single-use injection device; and (d) had the Defendant fluorial volume in a single-use injection device; and (e) had been melted into the Defendant’s left-use bloodline.

B. On November 4, 2016, the Defendant provided and administered philophones, and the Defendant is located in the head of Gangnam-gu Seoul Metropolitan Building H around November 4, 2016.
