A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. A person, other than a racing business entity, shall not engage in any profit-making activity relating to the purchase, arrangement, transfer, etc. of the voting rights of a winner or those similar thereto, or giving money to those who correctly predict the winner of a racing;

At the beginning of 2013, the defendant received a proposal that he would pay 2.5% of the amount deposited by the customer as points when he solicits customers from a person who is not named head of C's office, which is a horse racing site and a bicycle racing private gambling site.

The Defendant: (a) from January 2013 to December 2014, 2014, around Kimhae-si; (b) around 20, the Defendant placed 20, the Defendant’s seat at the Internet address of the Defendant, and the Defendant’s ID, which is a gambling site; and (c) deposited the gambling money into the gambling charging account; and (d) deposited the said gambling money with the members, the Defendant committed a profit-making act in relation to the purchase of the right to vote for riding on the bicycle racing site by receiving approximately KRW 2.5% of the printing amount, which is the sum of 2.5% of the printing amount, by receiving points that amount to KRW 20 million from the said gambling site.

2. He/she shall not engage in gambling for profit-making purposes in relation to the racing provided for in the Bicycle and Motorboat Racing Act;

On January 19, 2015, the Defendant transferred KRW 1100,000 to the national bank account in the name of D, which is the deposit account of the said C Gambling in an influent place (hereinafter referred to as the “Seoul Olympic Winter Games”), and received KRW 1.1 million points by accessing the said C site, and operated a bicycle racing by way of distributing KRW 1,487,546,61,69 in total on 2,065 occasions from August 7, 2012 to February 15, 2015, such as the name of light, Busan, and Changwon Winter Games Promotion Foundation’s bicycle racing business, which was implemented at the Seoul Olympic Winter Games Promotion Foundation.
