The defendant's appeal is dismissed.

1. Summary of grounds for appeal;

A. (1) In fact, the Defendant committed a violation of the Act on Promotion of the Use of Criminal Communications Network and Information Protection, etc. (Defamation) with respect to victims D, and the Defendant did not have the intention of defamation or defamation, and the Defendant was merely informed to the occupants of the fact that the victim refused to resign from the position of the representative of the occupants’ conference.

(2) The Defendant violated the Act on Promotion of the Utilization of Information and Communications Network Utilization and Information Protection, etc. (Defamation) with respect to the victim F did not have the purpose of slandering the victim. It is only to inform the occupant of the fact that the victim is engaged in surveillance of the privacy of the occupants of the apartment and activities for the resident representative committee.

(3) The expression “waste” in the notice of insulting the victim F does not refer to the victim.

B. The sentence of the lower court’s improper sentencing (2.5 million won) is too unreasonable.

2. Determination

A. (1) The Defendant alleged that there was a violation of the Act on Promotion of Utilization of Information and Communications Network Utilization and Information Protection, etc. (Defamation) with respect to the victim D, and the lower court also rejected the aforementioned assertion on the grounds as stated in its reasoning.

In light of the following circumstances, which can be recognized by the evidence duly adopted and investigated by the court below in light of the circumstances revealed by the court below, i.e., the fact that there was a defense between the defendant and the victim, but the victim’s expression “intition” was intended to defame the victim, the court below’s finding of facts and determination are justified.

Therefore, this part of the defendant's argument is without merit.

(2) The Defendant, in violation of the Act on Promotion of the Utilization of Information and Communications Network Utilization and Information Protection, Etc. (Defamation) with respect to the victim F, made an assertion to the same effect as the grounds for appeal in this part, and the lower court, based on the circumstances indicated in its reasoning.
