Reasons
Punishment of the crime
[Criminal Justice] On November 23, 2012, Defendant D was sentenced to imprisonment with prison labor for six months for violation of the Punishment of Violences, etc. Act (joint conflict) at the Sung-nam Branch of Suwon District Court on November 23, 2012 and the said judgment became final and conclusive on December 1, 2012.
[Judgment of the court below]
1. On November 13, 2012, Defendant A, Defendant A, and B found the victim H (14 years of age) and I (14 years of age) who had been living in the vicinity of the K middle school located in the Heung-gu J of Yong-gu, Chungcheongnam-gu, J on November 13, 2012, and Defendant A said victims as “LL middle school M or Handphone confirmationer,” and Defendant A said victims as “LL middle school M or Handphone confirmationer,” and were delivered one cell phone from the victim H of drinking, the market price of which is equivalent to KRW 700,000,000,000,000 from the victim I, respectively.
Accordingly, the above defendants jointly received property amounting to 1.4 million won in total by the victims.
2. Defendant A and C
가. 피고인 A, C은 E와 함께 2012. 10. 21. 15:50경 용인시 기흥구 J에 있는 ‘N’ 뒷골목에서 마침 그곳을 지나던 피해자 O(14세), P(14세)을 발견한 후 함께 다가가, 피해자들에게 “휴대폰을 내놔라, 만약 거짓말을 하면 이빨을 부숴버리겠다”라고 겁을 주고, 이에 겁을 먹은 피해자 O으로부터 시가 90만 원 상당의 갤럭시 S2 1대를, 피해자 P으로부터 시가 90만 원 상당의 갤럭시 S3 1대를 각각 교부받았다.
Accordingly, the above Defendants jointly received property worth KRW 1,80,000,000 in total from the victims jointly with E.
B. On October 21, 2012, Defendant A and C, along with Defendant D, found the victim Qu (13 years of age), R (12 years of age), G (13 years of age), and S (13 years of age) at the location of the temporary bus bus bus stop located in Yeongdeungpo-gu Gyeongdong-gu Gyeongdong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-si (hereinafter referred to as “13 years of age”).
