1. The attached list shall be the H 1,362 square meters, which shall be put to an auction, and the remainder after deducting the expenses for the auction from the proceeds shall be the same.
Reasons
1. Facts of recognition;
A. On April 12, 1979, Defendant F (6/29 shares), Defendant (Appointed Party; hereinafter “Defendant”) B (4/29 shares), Defendant G (4/29 shares), Defendant G (Appointed Party; hereinafter “Defendant”); Defendant C (Appointed Party; hereinafter “Defendant”); Defendant C (Appointed Party; hereinafter “Defendant”; 29 shares of 4/29 shares); Defendant E (1/29 shares); Defendant E (29 shares) and Defendant E (29 shares); 2/9 shares (29 shares) and network L (2/29 shares) registered ownership transfer on March 27, 1975.
B. Of the land before the instant partition, the share of 13/29 shares in the name of Defendant B, E, Selection I, J, and K was transferred to Defendant F on April 28, 2005.
C. 1) Of the land before the instant partition, a compulsory auction was conducted for the share of 4/29 shares owned by Defendant G, and on August 7, 2008, the registration of ownership transfer was completed due to the compulsory auction on July 3, 2008 to Defendant D on August 7, 2008. Defendant D filed a lawsuit for partition of co-owned property as the Suwon District Court Decision 2008Gadan98194 against Defendant E, F, G, Selection, J, K, and I.
On August 12, 2010, the said court rendered a ruling to the effect that the instant land was divided in kind into KRW 1,362 square meters (hereinafter “instant land”) and KRW 218 square meters among the land before the instant partition. The said ruling became final and conclusive around that time.
3) On February 7, 2010, Defendant D: (a) divided and completed the registration of ownership transfer of the land above M among the land before the instant partition; (b) Defendant D still entered 12/87 of the instant land in the name of Defendant D in the real estate register; (d) Defendant F donated shares of 19/87 of the instant land to the designated parties I, N, andO on August 9, 201; and (b) completed the registration of ownership transfer on the 12th of the same month.
2 Defendant B, Appointed K, and J shall file a claim for cancellation of ownership transfer registration with the Suwon District Court of Law No. 2011Kadan31506 against designated parties N.
