Reasons
Punishment of the crime
The victims of the 2017 senior 307- senior 307- defendant A, who committed the phishing crime, committed the crime by misrepresenting to the public prosecutor or prosecutor's office of financial companies, investigators, etc., and making phone calls to many unspecified victims in the Republic of Korea, one person who solicits a passbook in the name of another person to be used for the crime, one person who solicits a passbook in the name of another person, and one person who withdraws the money remitted from the above passbook to the above passbook from the victims in cash, respectively, shall be punished by acquiring the victims' money.
The Defendant, at the time of Scheon-si, on July 2016, misrepresented the name of the singing staff (N, O, etc.) of the singing staff, etc. of the said singing staff, together with the name of the singing staff of the said singing staff. On October 2016, the Defendant: (a) misrepresented the name of the sing staff of the said singing staff (P), together with the public prosecutor and investigator of the public prosecutor’s office and investigator; and (b) conspiredd with the said sing staff in order with the victims by making phone calls to the victims.
Accordingly, around July 5, 2016, the above Bosing employee called the victim Q Q Q and misrepresenting him to pay money to the account designated at a low interest rate in return for the payment of the existing loan. The employee received KRW 10 million from the victim to the Korean bank (Account Number S) account in the name of R R on the same day, from the time of receiving transfer of KRW 10 million from the victim to January 17, 2017, as shown in the List of Crimes 1, until the victim was paid KRW 59,7920,000 in total from the victims over 107 times in total.
Accordingly, the defendant, in collusion with the above Bosing staff, acquired the above KRW 59,7920,000 owned by the victims.
The staff members of the 2017 senior group 371- Defendants D, E, and F [Public Offering] who are named in China's Scheon-si shall assume the responsibility of the public prosecutor of the financial company or the public prosecutor's office, investigators, etc., and are not domestic and unspecified.
