A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Defendant is not a narcotics handler.

1. Purchasing marijuana;

A. On June 15, 2016, the Defendant transferred KRW 500,000 to the C’s account in order to purchase marijuana at a non-sckman’s place. On June 15, 2016, the Defendant purchased marijuana from the Defendant’s house located in Gangseo-gu Seoul Metropolitan Government D and B01 through Kwikset’s service.

B. On July 22, 2016, the Defendant, on July 21, 2016, exchanged KRW 1,000,000 in cash to the bitcoin’s address known to this “E” at a bitcoin, and purchased marijuana by means of receiving approximately 20g of hemp from the above Defendant’s office via Kwikset Services.

2. Smoking marijuana;

A. On June 15, 2016, the Defendant, at the Defendant’s home around June 15, 2016, posted approximately 0.5g g of hemp in the instant case and smoked by heating it.

B. On July 20, 2016, the Defendant committed a crime around July 20, 2016: (a) around July 20, 2016, around the alleyway around the main point of “G” located in Yongsan-gu Seoul, Yongsan-gu, Seoul; and (b) smoked in a way of smoking a tobacco with marijuana in the way of spreading the smoke.

On July 22, 2016, the Defendant committed the crime at around July 22, 2016, put about about approximately 0.5g g of hemp at the Defendant’s home in a stuff, and smoked by heating it.

On July 23, 2016, the Defendant, at the Defendant’s office around July 23, 2016, smoked in the same manner as described in the foregoing paragraph (c) at the Defendant’s house.

E. On July 30, 2016, the Defendant, at the Defendant’s home around July 30, 2016, smoked in the same manner as described in the foregoing paragraph (c) at the Defendant’s house.

F. On August 20, 2016, the Defendant, at the Defendant’s home around August 20, 2016, smoked in the same manner as described in the foregoing paragraph (c) at around August 20, 2016.
