A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On October 26, 2007, the Defendant received a summary order of KRW 1 million from the Suwon District Court to a fine of KRW 1 million due to a violation of the Road Traffic Act, and on April 17, 2013, the Defendant received a summary order of KRW 1 million from the Suwon District Court’s House as a fine of KRW 1 million due to the same crime.

On August 30, 2015, the Defendant driven two times under the influence of alcohol, and driven BSP car with a blood alcohol concentration of 0.130% 0.56% on August 30, 2015, and turned back the shooting distance in front of the agricultural cooperative, Seopung-dong and Seopung-dong, Seon-dong, Seoul, from the side of the school life, to the right side of the west stopdo while driving the vehicle under the influence of alcohol on two occasions.

Since there is a place that is connected to an intersection on a road where a central line is installed, in such cases, a person engaged in driving service shall safely drive the vehicle in compliance with the vehicle line, and the intersection has the duty of care to refrain from passing another vehicle.

Nevertheless, the Defendant neglected this and went beyond the median line to the opposite opposite line in order to overtake the k5-cab of the victim C(the age of 46) who was in the same lane while under the influence of alcohol, and returned to the opposite line by the center line, and the said taxi was invaded by the center line, and the bus was received by the victim D(the age of 54) who was in the middle of the two lanes.

Ultimately, the Defendant driving the said car in a situation where normal driving is difficult due to influence of drinking, and driving it on the part of the victim C for about two weeks, resulting in the injury of climatic salt, etc. which requires the victim D for about two weeks of medical treatment, the injury of climatic salt, etc., which requires about two weeks of medical treatment, the injury of the victim E, who is the passenger of the bus, and the victim E, who is the passenger of the bus, requires about two weeks of medical treatment, and the multiple climatic coordinates that require about three weeks of medical treatment to the bus victim F, who is the bus passenger, and the victim G, who is the passenger of the bus, for about 47 years of age.
