A defendant shall be punished by imprisonment for two years.

However, the execution of the above punishment shall be suspended for three years from the date this judgment became final and conclusive.

Punishment of the crime

The defendant of "2011 Highest 562" is the representative of the D Hospital in Masan-si, Ansan-si, Gyeonggi-si, who is an employer who operates the hospital by employing 30 full-time workers.

The Defendant did not pay the E’s wages of KRW 5,562,528 and retirement allowances of KRW 1,086,356, which he retired while working in the said D Hospital from June 10, 2009 to December 29, 201, within 14 days from the date on which the cause for the payment occurred, without agreement between the parties on the extension of the due date.

In addition, the Defendant did not pay the total amount of KRW 109,927,155 to 22 retired workers within 14 days from the date of occurrence of the cause for the payment without agreement between the parties on the extension of the time limit for payment, as stated in the Nos. 1 through 3, 5 through 7, 9, 12 through 16, 18 through 20, 22, 25, 27, 28, 32 through 34.

The Defendant is the representative of the D Hospital in Masan-si, Masan-si, Gyeonggi-do, who is an employer who operates the hospital with forty-eight regular workers employed.

The Defendant did not pay KRW 9,065,641, which was retired while working in the pertinent D Hospital from April 30, 2010 to December 26, 2010, within 14 days from the date on which the cause for the payment occurred, without agreement between the parties on the extension of the due date.

In addition, the Defendant did not pay the total amount of KRW 29,338,992, including wages and retirement allowances, to seven retired workers, within 14 days from the date on which the cause for the payment occurred, as described in the No. 1,6,9,11 through 14 of the attached Table 2 on the day of the crime committed.

The defendant of "2011 Highest 1370" is a medical specialist in general affairs who opens and operates a 'D' hospital located in Ansan-si, Ansan-si, Gyeonggi-do.
