1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
E is F and couple who completed the marriage report on December 5, 1995.
The Plaintiff is the mother of E, Defendant B is the mother of F, Defendant C is the mother of F, and Defendant C is the mother of F, and Defendant D is the spouse of Defendant C.
The Plaintiff: (a) on April 13, 2014, the Defendants were assaulted by F from E; (b) infringed upon his house without permission; and (c) caused the Plaintiff’s illness worse; and (d) sought payment of consolation money against the Defendants, a joint tortfeasor.
However, the Plaintiff stated the content of speech violence exercised by the Defendants in the complaint as follows: “I need to see why person is, why is, why is, what is, how to conduct family education.” The Plaintiff’s speech and behavior by the Defendants cannot be deemed to constitute a tort against the Plaintiff even in light of the Plaintiff’s assertion only.
Furthermore, in light of the purport of the whole pleading No. 1, E, on April 13, 2014, upon considering the Plaintiff’s entry of the evidence No. 1, due to the Plaintiff’s residence of the head, E suffered the outcome of this study by considering the Plaintiff’s head on the ground that F would go against his/her speech, and E received a disposition of suspension of indictment from the Daegu District Prosecutors’ Office due to these criminal facts, and the Defendants appears to have raised the meaning of the Plaintiff and E. Therefore, considering such circumstances, the testimony of the witness alone cannot be deemed as tort by the Defendants, and there is no other evidence to acknowledge this.
In short, the instant case can only be seen as a case where a dispute between the families was raised due to the assault between the couple and the wife, and the Defendants’ speech and behavior cannot be deemed as an unlawful act that infringes on the Plaintiff’s body, property, and personality rights or damages the peace of legal order.
For this reason, the plaintiff's claim is dismissed.
