A defendant shall be punished by imprisonment for not more than ten months.
Reasons
Punishment of the crime
1. On November 11, 2014, the Defendant violated the Road Traffic Act and the Guarantee of Automobile Accident Compensation Act: (a) drive a BM5 vehicle not covered by mandatory insurance on the front side of the “SM5 vehicle,” located in the Seogdong, Seogwon-gu, Seogwon-si, Chungcheongnam-si, Chungcheongnam-si, from the front side of the “SP subsidiary” to the road located in Seogwon-gu, Seogwon-si, Seogwon-si, Cheongju-si, who is under the influence of alcohol concentration of approximately 0.179%.
2. On November 21, 2014, the Defendant violated the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury caused by DM5) received the rear portion of DM5 car driven by the victim C (at the age of 40) who stops in the front side of the said SM5 car from the front side of the EM5 car while driving the BM5 car in the direction of the EM5 car from the right edge to the right edge distance. On November 21, 2014, the Defendant was under driving the CM5 car in the direction of the EM5 car in the direction of the EM5 distance. The Defendant got the back portion of DM5 car driven by the signal line from the front side of the EM5 car while driving the CM vehicle in the direction of the EM5 car in the direction of the EM distance.
As a result, the Defendant driven a motor vehicle in a state where normal driving is difficult due to influence of drinking, and suffered injury to the victim, such as cerebral ley which requires medical treatment for about three weeks.
Summary of Evidence
1. Police suspect interrogation protocol of the accused;

1. A traffic accident report, medical certificate, and photograph;
1. Notification of the results of the control of drinking driving, report on the circumstances of drinking drivers, and the application of Acts and subordinate statutes of the Mandatory Insurance Act;

Article 5-11 of the Act on the Aggravated Punishment, etc. of Specific Crimes (the point of injury caused by dangerous driving), Article 148-2 (2) 2 and Article 44 (1) of the Road Traffic Act (the point of sound driving) concerning criminal facts, and the former motor vehicle accident compensation.
