A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 공무집행방해 및 상해 피고인은 2014. 5. 26. 05:50경 부천시 원미구 신흥로 30 소재 전화국사거리 앞길에서 ‘수상한 차가 있다, 신호가 바뀌어도 그대로 있다, 창문을 두드려도 반응이 없다’는 내용의 112신고를 받고 출동한 부천원미경찰서 D지구대 소속 경장 E의 음주측정기 지원요청을 받고 현장에 온 위 D지구대 소속 경장 F이 음주측정을 위해 종이컵에 물을 따라주며 입을 행굴 것을 권유하자, 손으로 종이컵을 뿌리쳐 바닥에 떨어뜨리면서 음주측정 요구에 불응하며 “야 씹할 짭새새끼들아”라는 등 큰 소리로 욕설을 하며 주먹으로 피해자인 위 F(27세)의 얼굴 부분을 1회 때려, 피해자에게 약 2주 간의 치료가 필요한 턱관절 통증 상해를 가하였다.

As a result, the defendant interfered with the legitimate execution of duties of police officers on the site and the crackdown on drinking driving, and at the same time injured the victim.

2. At around 07:40 on May 26, 2014, the Defendant: (a) arrested a flagrant offender for the same reason as the above paragraph (1) at the office of the Criminal1 Team of the Busan High Police Station located in 84,000, Seocheon-si, Seocheon-si, 201, and the Defendant used violence, such as: (b) the Defendant’s strong resistance to the said police station’s criminal one team, and then, (c) the Defendant’s resistance to the said E, and (d) the head of the said E, etc. transferred the same to the said police station’s criminal1 team.

Accordingly, the defendant interfered with the legitimate execution of duties concerning the escort of police officers.

3. Violation of the Road Traffic Act (Refusal to measure a noise level) by the Defendant: (a) around 05:45 on May 26, 2014, while driving a GM7 car in front of the telephone station distance and driving it on the left-hand turn line among three-lanes while driving the car at the front of the telephone station distance, and driving it on the left-hand line; and (b) the Defendant was dispatched after receiving a 112 report due to locking.
