The defendant's appeal is dismissed.

All the costs of the original judgment and the trial shall be borne by the defendant.

1. The decision of the court below on the gist of the grounds of appeal is too unreasonable.

2. In full view of the various sentencing conditions as shown in the instant judgment records and arguments and the fact that the victim’s damage has not been recovered, the lower court’s punishment is too unreasonable.

3. According to the conclusion, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the defendant's appeal is groundless. It is so decided as per Disposition by the application of Articles 191 (1), 190 (1), and 186 (1) of the Criminal Procedure Act on the burden of litigation costs.
