Reasons
Punishment of the crime
Defendant
On January 25, 2013, A was sentenced to the suspension of the execution for six months by imprisonment with prison labor for a violation of the Pharmaceutical Affairs Act by the District Court of the Republic of Korea, and on February 2, 2013, the said judgment became final and conclusive.
1. Defendant A operated a pharmacy from December 28, 201 to July 2012 by means of borrowing a pharmacist’s license from the JA pharmacy on the first floor of both weeks, and from the pharmacist who is not a pharmacist, even though he was unable to establish a pharmacy, Defendant A operated the pharmacy in the manner of paying 1.5 million won a monthly license fee to the above B.
As a result, the Defendant established a JA even though he is not a pharmacist.
2. Defendant B lent his pharmaceutical license to the said Party A without a pharmaceutical license from December 28, 201 to July 2012, 201, to K without a pharmaceutical license, from July 28, 2012 to October 4, 2012, Defendant B lent his/her pharmaceutical license to the said Party A without a pharmaceutical license, with a condition of KRW 1.5 million per month from July 2012 to October 4, 2012.
Accordingly, the defendant lent his pharmaceutical license to A and K respectively.
3. Defendant C lent his pharmaceutical license to the above KK without a pharmacist’s license from September 1, 2001 to September 29, 2009, on condition that the above KK can establish a pharmacy on condition that it will receive from September 1, 2001 to 3.5 million won per month.
Accordingly, the defendant lent his pharmaceutical license to the above K.
4. At around November 2011, Defendant D introduced the above A to the above B so that the said A, not a pharmacist, can establish a pharmacy by lending a pharmacist’s license from the J Pharmacy located in the first floor in Yangju-si, Yangju-si.
Accordingly, the Defendant, not pharmacists, aided and abetted the above A to establish a J Pharmacy.
