A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

1. On June 28, 2017, the Defendant: (a) driven a Dhand vehicle while drinking alcohol around 20:00; (b) driven the Dhand vehicle in front of the “driving-do,” located in 15, a 3rd-ro, Jung-gu, Gwangju; (c) was found to have violated signal from the GNN police station I affiliated with the GNN police station of the Gwangju Northernbuk-gu, Gwangju; and (d) was driven under the influence of alcohol by the Defendant, such as smelling alcohol and snicking on face.

Due to reasonable grounds, there was a demand from around 20:20 to around 20:47 of the same day to respond to the measurement of drinking alcohol by inserting approximately approximately 27 minutes of the drinking measuring instrument.

그럼에도 피고인은 음주 측정기에 입김을 불어넣는 시늉을 한 후 이를 계속 거부하여 정당한 사유 없이 경찰공무원의 음주 측정요구에 응하지 아니하였다.

2. 공무집행 방해 피고인은 위 일 시경 위 ‘ 행복 빌’ 앞길에서 경사 J으로부터 음주 측정을 요구 받았음에도 불구하고 음주측정기에 입김을 불어넣는 시늉을 한 후 이를 계속 거부하다가 같은 날 20:30 경 “ 물을 마시고 불겠다 ”며 입 헹굼 용 물을 달라고 요구하여, 경사 J이 피고인에게 물을 한 잔 따라 주자, 오른손으로 들고 있던 종이컵 속에 든 물을 경사 J의 얼굴에 뿌리는 등 폭행하여 경찰공무원의 음주 측정 등에 관한 정당한 직무집행을 방해하였다.
