1. The Defendant’s KRW 50,000,000 as well as the Plaintiff’s annual rate from September 9, 2015 to September 30, 2015.
Reasons
1. On August 15, 2013, the Plaintiff, the Defendant, and Nonparty C agreed to invest KRW 50,000,000 in each of the Defendant and C in the company run by the Plaintiff. On April 18, 2015, the Defendant agreed to terminate the partnership business and agreed to pay KRW 50,000,000 to the Plaintiff by July 31, 2015.
2. Judgment without holding any pleadings (Articles 208 (3) 1 and 257 of the Civil Procedure Act);
3. The provisions concerning statutory interest rate under Article 3(1) of the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings, Etc., amended to the effect that the statutory interest rate under the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings is changed to 15% per annum from October 1, 2015.
