Punishment of the crime

On December 23, 2016, the Defendant was sentenced to four months in Seoul Southern District Court due to a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes, etc., and the execution of the sentence was completed on April 20, 2017.

On August 25, 2018, around 20:20 on August 25, 2018, the Defendant committed an indecent act by force against the victim C (the victim, 26 years of age, and Gam) taking photographs of a mobile phone from the front side of Yangcheon-gu Seoul Metropolitan Government (the victim).

그러나 피해자는 사건발생 장소, 당시 피해자가 입고 있었던 옷, 인도에 서 있던 피해자가 앞에서 걸어오고 있는 피고인을 발견하고 피고인이 지나갈 수 있도록 도로 쪽으로 들어가 길을 비켜주었던 상황, 피고인이 피해자 쪽으로 붙어 교차하여 지나가던 당시의 상황, 추행의 방법, 추행 부위와 그 정도, 당시 느꼈던 감정, 추행 이후 피고인이 보인 행위태양, 경찰에 신고하게 되기까지의 과정 등에 대하여 일관되고도 구체적으로 진술하고 있고, 이 법정에서의 태도 역시 자연스럽고 꾸밈이 없었다.

On the day of the case, there is no obvious motive for the victim to gather the defendant by emphasizing the risk that the victim would be punished for perjury and tending false facts.

According to the statements of the victim with credibility, the facts charged of this case is guilty.
