A defendant shall be punished by imprisonment for not less than two months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant was the representative director of the Dispute Resolution Co., Ltd. from July 26, 2017 to June 27, 2018, and D is the representative director of the said company, and E is the manager of the said company and the debtor of the said company.

1. On August 2017, the Defendant: (a) received and kept “stock transfer/acquisition agreement” as stated in “C”, “transfer amount: KRW 1,350,000”, “transfer amount: KRW 1,350,00”, “Transferor: D”, “A”, and “Date of Preparation”, “A” and “ August 2017,” and “B”, respectively.

On June 27, 2018, the Defendant reported the above contract, which was held by shareholders of the above company, to the tax office, and intended to take over the shares, and exercise voting rights as the largest shareholder. On June 27, 2018, the Defendant was able to change the date of preparation of the contract, with concerns over the imposition of fines for negligence due to late reporting.

On July 2, 2018, the Defendant entered “7” in the office of the branch office south of G Accounting Corporation, which was located in the F, using the modified tape, and entered “8” in the letter “8” in August 2, 2017, and written the said contract at will, stating “2” in the column of the date on which the contract was entered.

Accordingly, the defendant modified the transfer and acquisition contract of private document.

2. Around July 27, 2018, the Defendant submitted a modified private document to a public official in charge of interest in his name, who is unaware of the fact that the altered “a contract for the transfer and acquisition of shares” was made as stated in the foregoing paragraph (1).
