Reasons
Punishment of the crime
The victim B is the head of the management office of the Busan Northern-gu C Apartment, and the defendant is the chairperson of the "Emergency Countermeasure Committee" established for the purpose of normalizing the above apartment.
On September 26, 2019, around 10:03, the Defendant removed the public notice notice that “the result of the special audit by the North Korean office” attached by the victim, which was prepared in the name of the head of the management office (B) of the apartment of the E and F Complex in the north-gu Seoul metropolitan apartment D apartment in Busan, from the same day to October 11, 2019, the Defendant arbitrarily removed the public notice five times as shown in the list of crimes.
Summary of Evidence

1. A police statement investigation report (CCTV image attachment report), and the Defendant asserts that removing a notice of the facts stated in the judgment that was posted inside the elevator, not a designated posting place, constitutes a justifiable act.
However, the following facts and circumstances recognized by the evidence duly examined by this court, i.e., the notice of each criminal facts in the judgment, which is the head of the management office, is the sign attached to the position of the management office. ② Article 13(5) of the apartment management rules stated in the judgment, which is subject to the consent of the tenant's representative meeting when occupants attach signs to places outside the designated bulletin board, can not be seen as applicable to the signs attached by the management office. ③ Article 63(1)1 of the Multi-Family Housing Management Act provides that the management entity shall perform the maintenance of common areas, and Article 19(2)3 of the Enforcement Decree of the Multi-Family Housing Management Act provides that occupants, etc. shall only obtain the consent of the management body when attaching signs to multi-family housing.
