Defendant
A shall be punished by a fine for negligence of KRW 2,000,000, and by a fine of KRW 500,000.
The above fines are imposed by the Defendants.
Reasons
Punishment of the crime
1. The parties concerned Defendant A is the operator of Company D (hereinafter “D”) located on the first floor underground of the building C in Jung-gu Seoul, Seoul, and Defendant B is the director of Company D, and Victim E operates F Kafs at a store leased by D according to a business operation agency contract with D.
2. Defendant A’s interference with business;
A. On January 15, 2015, the Defendant: (a) around January 15, 2015, at D office around January 15, 2015, the Defendant: (b) had the victim use the POS (credit card terminal) of another company that is not D in violation of the business operation agency contract; (c) had B interfered with the F Kaf’s business by saying that B would block the electricity of the F Kaf operated by the victim; and (d) had B interfered with the F Kaf’s business.
Accordingly, around 11:00 on January 15, 2015, B prevented the victim's operation by force by blocking electricity from F carpets until January 15, 2015, which is located in front of F carpets with the first floor B1060 underground floor B of C building.
Accordingly, the defendant instigated B to interfere with the victim's work.
B. On January 15, 2015, around 14:00 on January 15, 2015, the Defendant of the obstruction teacher’s business at D office around January 15, 2015, and KRW 2.
For the same reason, B instructed B to cut off F Kapet electricity and let B get the electric breaker in front of F Kapet, and prevented F Kapet electricity from blocking from January 15, 2015 to January 14:30, 2015, thereby obstructing the victim's business operation by force.
Accordingly, the defendant instigated B to interfere with the victim's work.
C. On January 16, 2015, around 13:50 on January 16, 2015, the Defendant of the obstruction teacher’s business at D office around January 16, 2015, and KRW 2.
For the same reason, B instructed B to block F Kapet electricity, and caused B to stop electricity in front of F Kapet, thereby blocking F Kapet electricity from January 16, 2015 to interfere with the victim's business operation by force.
